1. Agreement to Terms

By accessing and using the Mimocho website (the "Site") and purchasing our products, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Mimocho ("we," "us," or "our"). If you do not agree with any part of these Terms, you must not use our Site or services.

2. Products and Orders

Mimocho offers for sale a curated selection of writing instruments, paper & journals, art supplies, and desk accessories. All product descriptions, images, and prices are subject to change without notice. We reserve the right to discontinue any product at any time. Your placement of an order constitutes an offer to purchase, which we may accept or decline at our sole discretion. We will notify you of order acceptance via email. Any errors in product information, pricing, or availability do not constitute a binding contract until order confirmation.

3. Limitation of Liability

To the fullest extent permitted by applicable law, Mimocho, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or use, arising out of or in any way connected with your use of the Site or products, even if advised of the possibility of such damages. Our total cumulative liability to you for all claims arising from or related to the Site or products shall not exceed the total amount you paid to Mimocho for the specific product giving rise to the claim in the twelve (12) months prior to the event giving rise to liability.

The Site and products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, secure, or error-free.

4. Intellectual Property Protection

All content on the Mimocho Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the overall "look and feel" of the Site, is the exclusive property of Mimocho or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute any material from this Site, including code and software, for commercial or public purposes without our prior written consent. The Mimocho name and logo, and all related product and service names, are trademarks of Mimocho and may not be used without express written permission.

5. Refund & Return Policy

We strive for complete customer satisfaction. If you are not satisfied with your purchase, you may return most new, unopened, and unused items in their original packaging within 30 days of delivery for a full refund of the product price. Shipping costs are non-refundable. Returned items must be in resalable condition.

To initiate a return, please contact our customer support team at [email protected] with your order number and reason for return. You will receive instructions and a Return Merchandise Authorization (RMA) number. Refunds will be processed to the original method of payment within 10 business days after we receive and inspect the returned item.

This policy does not apply to items marked as final sale, personalized/customized products, or items damaged due to customer misuse. For defective or incorrectly shipped items, please contact us immediately upon receipt.

6. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
